Disclaimer

HAAST is designed to enable the New Zealand Defence Force and wider flight community to share information about where low level aircraft may be operating at a particular time. It displays information relating to aircraft operators’ intentions only. An aircraft operator’s intentions may change even though the operator does not update the information on HAAST. ATEC (Accredited Technology (ATEC) Limited and New Zealand Defence Force, together, the provider of HAAST) does not independently check to ensure the information is correct, accurate, complete or suitable for your use.

HAAST does not monitor or verify the accuracy of any information displayed (including actual flights or the flight paths that are taken or any hazard information reported). The information displayed on HAAST is not official aeronautical information and is displayed as general guidance for situational awareness purposes only and should not be relied on as the sole basis for your decisions relating to any flight, planning, safety or operational activities relating to aircraft operations. You agree that:

Your use of HAAST is subject to you agreeing to the HAAST Terms of Use.

HAAST Terms of Use

  1. APPLICATION OF TERMS

    1. These Terms apply to your use of HAAST. By accessing and using HAAST:

      1. you agree to these Terms; and

      2. where your access and use is on behalf of another person (e.g. a company), you confirm that you are authorised to, and do in fact, agree to these Terms on that person’s behalf and that, by agreeing to these Terms on that person’s behalf, that person is bound by these Terms.

    2. If you do not agree to these Terms, you are not authorised to access and use HAAST, and you must immediately stop doing so.

  2. CHANGES

    1. We may change these Terms at any time by updating them on HAAST. Unless stated otherwise, any change takes effect immediately. You are responsible for ensuring that you are familiar with the latest Terms. By continuing to access and use HAAST, you agree to be bound by the changed Terms.

    2. We may change, suspend, discontinue, or restrict access to, HAAST without notice or liability.

    3. These Terms were last updated on 19 July 2026.

  3. DEFINITIONS

    In these Terms:

    • contact details has the meaning given in clause 4.1;

    • Flight Information means any flight intention information and/or obstacle reporting uploaded onto HAAST by you or another user of HAAST, including intentions of where aircraft may be operating and when;

    • HAAST means the web application provided on the Website for the purposes of notifying users of intended low level flights by the NZDF and other low level aviation participants who use HAAST.

    • including and similar words do not imply any limit;

    • Loss includes loss of profits, savings, revenue or data, and any other claim, damage, loss, liability and cost, including legal costs on a solicitor and own client basis;

    • NZDF means New Zealand Defence Force;

    • personal information means information about an identifiable, living person;

    • Terms means these terms and conditions titled HAAST Terms of Use;

    • Underlying System means any network, system, software, data or material that underlies or is connected to the HAAST, including the Website;

    • User ID means a unique name and/or password allocated to you to allow you to access certain parts of the HAAST and to upload Flight Information;

    • We, us or our means Accredited Technology (ATEC) Limited, company number 3746981;

    • Website means haastaero.com (and any sub-domains), as that website is updated by us from time to time; and

    • You means you or, if clause 1.1b applies, both you and the other person on whose behalf you are acting.

  4. YOUR ACCOUNT AND OBLIGATIONS

    1. Setting up an account to use HAAST and to obtain a User ID is subject to NZDF verifying your identity. To do this, you will need to provide a copy of a specified identification document (e.g. driver’s licence or pilot’s licence) and provide other contact details (contact details), including your name, your organisation’s name (if applicable), your email address, and your contact phone number. Your identification document and contact details are then supplied to NZDF to verify your identity. We do not retain the copy of your identification document but do retain your contact details for account maintenance, compliance, and contact purposes.

    2. You must provide true, current and complete information in your dealings with us (including when setting up an account and uploading Flight Information onto HAAST), and must promptly update that information as required so that the information remains true, current and complete.

    3. If you are given a User ID, you must keep your User ID secure and:

      1. not permit any other person to use your User ID, including not disclosing or providing it to any other person; and

      2. immediately notify us if you become aware of any disclosure or unauthorised use of your User ID, by submitting a feedback request through the Website or by sending an email to HAAST@nzdf.mil.nz.

    4. You must:

      1. not act in a way, or use or introduce anything (including any virus, worm, Trojan horse, timebomb, keystroke logger, spyware or other similar feature) that in any way compromises, or may compromise, HAAST or any Underlying System, or otherwise attempt to damage or interfere with HAAST or any Underlying System;

      2. unless with our agreement, access HAAST via standard web browsers only and not by any other method. Other methods include scraping, deep-linking, harvesting, data mining, use of a robot or spider, automation, or any similar data gathering, extraction or monitoring method; and

      3. not copy, reproduce, adapt, translate, reverse-engineer or make derivative works from the whole or any part of HAAST or the Underlying Systems.

    5. You must not use HAAST other than for your own lawful personal (where you are an individual) or your lawful internal business (where you are a business) purposes. You must not copy or use any of the Flight Information for any other purpose, including disclosing it to any third party.

    6. You must obtain our written permission to establish a link to HAAST. If you wish to do so, make a request via the Feedback function of the Website.

  5. INTELLECTUAL PROPERTY

    1. We (and our licensors) own all proprietary and intellectual property rights in HAAST (including all information, data, text, graphics, artwork, photographs, logos, icons, sound recordings, videos and look and feel) and the Underlying Systems.

    2. You consent to us using your Flight Information and information about your use of HAAST to generate anonymised and aggregated statistical and analytical data (Analytical Data). We may use Analytical Data for our internal research and product development and improvement purposes and to conduct statistical analysis and identify trends, insights and other reports, which may be made available to third parties. Title to, and intellectual property rights in the Analytical Data is and remains our property.

  6. PRIVACY

    1. We only collect personal information about you if you open a HAAST account. The personal information we collect is described in clause 4.1. You are not required to provide personal information to us, although if you do not, then you will be unable to set up an account and access and use HAAST.

    2. We comply with the New Zealand Privacy Act 2020 when you provide personal information to us.

    3. You agree to NZDF using your personal information as follows:

      1. where you supply an identification document to verify your identity, you are required to upload this to HAAST to enable the NZDF to complete the verification. We do not keep a copy of this document;

      2. where you supply contact details, we also provide this information to NZDF. NZDF and we use this contact information to communicate with you relating to HAAST and Flight Information, including (where you subscribe to updates) providing you with those updates, responding to queries, or enforcing these Terms; and

      3. when you supply Flight Information:

        1. your contact details will be made available with that information to enable other flight operators to contact you about that information. You may choose to hide your contact details by checking the relevant option; and

        2. where your Flight Information conflicts with other information (e.g. multiple users have indicated that they will be flying in the same area at the same time), by default each relevant user’s contact details will be supplied to the other affected users to facilitate communications to resolve the conflict. You have the option to hide this information from other users, however your aircraft callsign and aircraft model may be shared with the other affected users in the event of a flight area conflict being detected by the system, even if you have chosen to hide those details. This is to to assist with deconfliction.

    4. Where you have an account with HAAST, you may generate a report detailing the information (including personal information) that HAAST has recorded about you.

    5. We may also collect technical information when you visit HAAST. This may include information about the way you arrive at, browse through, and interact with HAAST. We may collect this type of technical information through the use of cookies and other means. If you want to disable cookies, you may do so by changing the settings on your browser. However, if you do so, you may not be able to use all of the functions on HAAST. We use the technical information we collect to have a better understanding of the way people use HAAST, to improve the way it works and to personalise it.

    6. Generally, we do not disclose personal information to third parties for them to use for their own purposes. But we may disclose your personal information as follows:

      1. to NZDF, as described in clauses 6.3a and 6.3b;

      2. to service providers and other persons working with us to make HAAST available or improve or develop its functionality;

      3. in relation to the proposed purchase or acquisition of our business or assets; or

      4. where required by applicable law or any court, or in response to a legitimate request by a law enforcement agency.

    7. Any personal information you provide to us may be stored on the secure servers of our trusted service providers, which will be located in Australia and/or New Zealand. This may mean your personal information is held and processed outside New Zealand.

    8. As required by applicable law, we will take steps to keep your personal information safe from loss, unauthorised activity, or other misuse. We implement appropriate technical and organisational measures to ensure security appropriate to the risks inherent in processing personal information.

    9. You have the right to request access to and correction of any of the personal information we hold about you. If you would like to exercise these rights, please request this via the Feedback function on the Website.

  7. DISCLAIMER

    1. Without limiting the HAAST disclaimer, and to the extent permitted by law, we and our licensors have no liability or responsibility to you or any other person for any Loss in connection with:

      1. HAAST being unavailable (in whole or in part) or performing slowly;

      2. any Flight Information, including any error in or omission from that information;

      3. any exposure to viruses or other forms of interference which may damage your computer system or expose you to fraud when you access or use HAAST. You are responsible for ensuring the process by which you access and use HAAST protects you from this; and

      4. any site linked from HAAST. Any link on HAAST to other sites does not imply any endorsement, approval or recommendation of, or responsibility for, those sites or their contents, operations, products or operators.

    2. Without limiting clause 7.1:

      1. you rely on the Flight Information at your own risk; and

      2. you acknowledge that we do not, control, inspect, endorse, approve or check the correctness, accuracy, completeness or suitability for your use, of the Flight Information, and it is your responsibility to do so. The Flight Information is displayed as general guidance only and should not be relied upon as the sole basis for your decisions relating to any flight, planning, safety or operational activities relating to your aircraft operations.

  8. LIABILITY

    1. To the maximum extent permitted by law:

      1. you access and use the HAAST and the Flight Information at your own risk; and

      2. neither we nor NZDF are not liable or responsible to you or any other person for any Loss under or in connection with these Terms, HAAST, the Flight Information, or your access and use of (or inability to access or use) HAAST or the Flight Information. This exclusion applies regardless of whether our or NZDF’s liability or responsibility arises in contract, tort (including negligence), equity, breach of statutory duty, or otherwise.

    2. To the extent permitted by law and only to the extent clause 8.1 of these Terms does not apply, our and NZDF’s combined total liability to you under or in connection with these Terms, or in connection with HAAST and the Flight Information, or your access and use of (or inability to access or use) HAAST and the Flight Information, must not exceed NZD100.

    3. Except to the extent permitted by law, nothing in these Terms has the effect of contracting out of the New Zealand Consumer Guarantees Act 1993 or any other consumer protection law that cannot be excluded. To the extent our liability cannot be excluded but can be limited, our liability is limited to the cap set out in clause 8.2.

  9. SUSPENSION AND TERMINATION

    1. Without prejudice to any other right or remedy available to us, if we consider that you have breached these Terms or we otherwise consider it appropriate, we may immediately, and without notice, suspend or terminate your access to HAAST (or any part of it).

    2. On suspension or termination, you must immediately cease using HAAST and must not attempt to gain further access.

  10. GENERAL

    1. If we need to contact you, we may do so by email. You agree that this satisfies all legal requirements in relation to written communications.

    2. These Terms, and any dispute relating to these Terms, HAAST, or the Flight Information, are governed by and must be interpreted in accordance with the laws of New Zealand. Each party submits to the non-exclusive jurisdiction of the Courts of New Zealand in relation to any dispute connected with these Terms, HAAST, or the Flight Information.

    3. For us to waive a right under these Terms, the waiver must be in writing.

    4. Clauses which, by their nature, are intended to survive termination of these Terms, including clauses 5, 7, 8, 10.2, and 10.4, continue in force.

    5. These Terms set out everything agreed by the parties relating to your use of HAAST and the Flight Information, and supersede and cancel anything discussed, exchanged or agreed prior to you agreeing to these Terms. The parties have not relied on any representation, warranty or agreement relating to the Website that is not expressly set out in the Terms, and no such representation, warranty or agreement has any effect from the date you agreed to these Terms.
